ACTUAL SUSPENSION UNDER 90 DAYS

                Same as stayed suspension and probation, however, actual period of time, under 90 days, where attorney is prohibited from practicing law.

 ACTUAL SUSPENSION 90 DAYS OR MORE, LESS THAN TWO YEARS

                In addition to inability to practice law for specified time and probation conditions, attorney must comply with Rule 955 of California Rules of Court, notifying by certified mail all clients, opposing counsel and co-counsel and filing notice in courts where matters pending of attorney’s inability to practice due to suspension.  Attorney must also file affidavit of compliance with State Bar Court.

ACTUAL SUSPENSION TWO YEARS OR MORE

                Same as suspension 90 days or greater, but additionally before suspension ends, attorney must prove by preponderance of evidence to satisfaction of State Bar Court that:  (1) attorney has present learning and ability in law; (2) attorney has been rehabilitated; and (3) attorney is of good moral character.
